Terms of Service

These terms are an agreement between cristiansimion.com (“we”) and the client, and they govern the development subscription sold on this site. The service is for businesses and professionals; by subscribing you confirm you are buying for your trade, not as a private consumer. Where the marketing pages and these terms differ, these terms control.

The subscription buys one active task at a time, worked until it is finished, with as many tasks as you like in your queue. You receive an honest estimate before work starts on any task, and larger work is broken into tasks with you. Turnaround times on this site are good-faith estimates, not guarantees. New clients go through a short onboarding check before the first task starts, and we may decline a subscription at our discretion, in which case what you paid is returned, less the payment processor’s non-refundable fees. A quick intro call before subscribing is the easy way to make sure that never happens.

The subscription is paid monthly, in advance, in US dollars, and renews each month until you cancel. Cancelling takes one click or one email, needs no notice, and takes effect at the end of the month you paid for. Nothing else holds you here, and that is deliberate. You can also pause: unused days are banked for up to twelve months and work resumes where it stopped.

If the first week tells you it is not working, say so within seven days of your first payment and 75% of that month comes back, no forms, no argument. That offer applies once, to your first month ever, and taking it ends the service immediately; the retained 25% pays for the week of service, and work delivered in it stays yours.

Beyond that guarantee, payments are not refundable. Requests outside it are reviewed case by case and granted solely at our discretion, completed work is never refundable, and where a discretionary refund is granted, the payment processor’s non-refundable fees may be deducted from the amount returned.

Usually the better move is neither refund nor cancellation: pause the subscription instead. Your unused days are banked for up to twelve months, billing stops, and the work resumes exactly where it left off when you have more to send.

You do. All work created for you under a paid subscription is yours, from the first commit, including unfinished work if you leave. Our pre-existing tools and know-how stay ours, and you get a permanent free licence to use them as embedded in your deliverables. Open-source components keep their own licences.

You give timely feedback, provide the access the work needs, and only supply materials you have the right to use. Anything you share with us stays confidential, and we expect the same of our methods and unreleased work. We will not build cryptocurrency projects or anything illegal or deceptive, and we may decline any task.

White-label work for agencies ships under the agency’s brand, the agency keeps its client relationships, and we never showcase white-label work without written permission. Other work may appear in our portfolio, identified by client name, unless you ask us not to.

The work is done with the skill and care of a competent senior engineer; beyond that it is provided as is, with no implied warranties and no promise of business outcomes. Neither side is liable to the other for indirect losses, and our total liability is capped at the fees you paid in the three months before the claim.

These terms are governed by the laws of the State of Delaware, USA. Disputes we cannot settle between ourselves go to binding arbitration under the American Arbitration Association’s rules, one arbitrator, in English, conducted remotely.

If these terms change materially, subscribers are told by email and changes apply from the next month you choose to pay, never retroactively. Questions: contact@cristiansimion.com.
